This is the Privacy Policy for https://www.soykitty.com (“Site”), which is owned and operated by SoyKitty, LLC (“Company” or “we” or “us” or “our”).

What information we collect

Information you provide directly to us:

  • Registration Information: When you create a SoyKitty Account, we collect Personal Information, such as your name, date of birth, billing and shipping address, payment information (e.g., credit card) and contact information (e.g., email and phone number).
  • User Content: Some of our Services allow you to create and post or upload User Content. For example, User Content includes any discussions, posts, or messages you send on SoyKitty’s blogs and forums. You should be aware that any information you provide or post in these areas may be read, collected, and used by others who access them. To request that we remove or de-identify your Personal Information from our blog or forums, simply contact us at meow@soykitty.com. Please note that whenever you post something publicly, it may sometimes be impossible to remove all instances of the posted information (for example, if someone has taken a screenshot of your posting). Please exercise caution before choosing to share your Personal Information publicly on our blogs, forums or in any other posting. You may be required to register with a third party application to post a comment. To learn how the third party application uses your information, please review the third party’s privacy policy.
  • Social media features and widgets: Our Services include social media features, such as the Facebook “Like” or “Share” buttons and widgets. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. Features may also allow third party social media services to provide us with information about you, including your name, email address, and other contact information. The information we receive is dependent upon your privacy settings with the social network. Features are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policies of the third party companies providing them. You should always review and, if necessary, adjust your privacy settings on third party websites and services before linking or connecting them to our Sites or other Services.
  • Third party services (e.g., social media): If you use a third party site, such as Facebook or Twitter, in connection with our Services to communicate with another person (e.g., to make or post referrals or to request that we communicate with another person), then, in addition to that person’s name and contact information, we may also collect other information (e.g., your profile picture, network, gender, username, user ID, age range, language, country, friends lists or followers) depending on your privacy settings on the third party site. We do not control the third party site’s information practices, so please review the third party’s privacy policy and your settings on the third party’s site carefully.
  • Customer service: When you contact SoyKitty Customer Support or correspond with us about our Products, we collect information to track and respond to your inquiry, investigate any breach of our Privacy Policy or applicable laws or regulations, and analyze and improve our products and services.

Web-Behavior Information

We and our third party service providers use cookies and similar technologies (such as web beacons, tags, scripts and device identifiers) to collect information on how you use our Sites (e.g., browser type, domains, page views). We use this information to:

  • help us recognize you when you use our Services;
  • customize and improve your experience;
  • secure our Services;
  • analyze usage of our Services (such as to analyze your interactions with the results, reports, and other features of the Services);
  • gather demographic information about our user base;
  • offer our Services to you;
  • monitor the success of marketing programs; and
  • serve targeted advertising on our Sites and on other sites around the Internet.

Collection of Other Information, Cookies, and Cookie Opt-Out

We also may automatically collect non-personal information that does not identify an individual user, such as IP (internet protocol) address, ISP (internet service provider), the Web browser used to visit the Site, the time the Site is visited, which Web pages were visited on the Site, a unique mobile device identifier (in connection with the use of the Sites or related services from mobile devices) and other anonymous Site usage data.

We may also collect and collect personal information and non-personal information from users via “cookies” (small text files placed by us on user computers and stored there by their browser while they are browsing our Site), single-pixel GIF image files (also called “Web beacons”), Web server log analysis and other similar technologies. Such information may be used to track usage trends and enhance the user experience, and may be shared with third parties.

Without cookies it would be impossible to provide you information and services you are requesting through the Internet. Cookies remember certain information (such as items added in the shopping cart in an online store) and may record your browsing activity. They can also be used to remember arbitrary pieces of information that the user previously entered into form fields, such as names, addresses, passwords and billing address.

By using the Site, you agree to the use of any of the cookies and tracking tools mentioned in this policy, unless you opt out from such use (opt out available only for some cookie types). Your browser gives you the ability to control cookies. How to do this varies from browser to browser. You should view the Help menu on the browser you use for further information. Your opt-out choice is stored only in that browser, so you should separately set your preferences for other browsers, computers, or devices you may use. If you do opt out of cookies, it may impair our ability to deliver, and your ability to receive, all the services and benefits of the Site.

How we use your information

  • To provide you with Services and analyze and improve our Services: We use your information to operate, provide, analyze and improve our Services. These activities may include, among other things, using your information in a manner consistent with this Privacy Policy to open your SoyKitty Account, enable purchases, process payments, communicate with you, and implement your requests (e.g., referrals, enable and enhance your use of our Sites), including authenticating your visits, providing personalized content and information, and tracking your usage of our Services, contact you about your SoyKitty Account and any relevant information about our Services (e.g. policy changes, security updates or issues, etc.), enforce SoyKitty Terms of Service and other agreements, monitor, detect, investigate and prevent prohibited or illegal behaviors on our Services, combat spam and other security risks, and perform research, development and commercial activities, which may include, for example, conducting data analysis and research in order to develop new, or improve existing, products and services, and performing quality control activities. Please see Section 5 below for more information on our analytics and advertising activities.
  • To provide customer support: When you contact SoyKitty Customer Support, we may use or request your Personal Information, as necessary to answer your questions, resolve disputes, and/or investigate and troubleshoot problems or complaints. In some instances, we may be required to process one customer’s Personal Information to resolve another customer’s dispute or request. For example, if a customer reports behavior that violates our Terms of Service, we will separately process both customers’ Personal Information and respond separately to each individual as appropriate. We will not share your Personal Information with another customer without your consent.
  • To conduct surveys or polls and obtain testimonials: We value your feedback and may send you surveys, polls, or requests for testimonials to improve and optimize our Services. You are in control of the information you would like to share with us.
  • To provide you with marketing communications: By creating a SoyKitty Account, you are agreeing that we may send you product and promotional emails or notifications about our Services, and offers on new products, services, promotions or contests. You can unsubscribe from receiving these marketing communications at any time. To unsubscribe, click the email footer “unsubscribe”. You may not opt-out of receiving non-promotional messages regarding your SoyKitty Account, such as technical notices, purchase confirmations, or Service-related emails.

How we share your information

  • General service providers: We share Personal Information with our third party service providers, as necessary for them to provide their services to us and help us provide the Services to you. SoyKitty engages some third party service providers to assist in supporting our Services, including in the following areas:
    • Order fulfillment and shipping: Our payment processor processes certain of your Registration Information, such as your billing address and credit card information, as necessary to enable you to purchase the Services from our Sites. Our distribution centers or warehouses ship your package to you.
    • Customer support: Our support team uses a number of tools to help organize and manage the requests we receive. These tools help us provide timely, high quality support.
    • Cloud storage, IT, and Security: Our cloud storage providers provide secure storage for information in SoyKitty databases, ensure that our infrastructure can support continued use of our Services by our customers, and protect data in the event of a natural disaster or other disruption to the Services. Our IT and security providers assist with intrusion detection and prevention measures to help stop any potential attacks against our networks. We have these third party experts perform regular penetration tests and periodically audit SoyKitty’ security controls.
    • Marketing and analytics: When you use our Services, including our Sites, our third party service providers may collect information about your visit, such as the links you clicked on, the duration of your visit, and the URLs you visited. This information can help us improve site navigability and assess our marketing campaigns. Please see Section 5 below for more information on our analytics and advertising activities.
  • “Targeted advertising” service providers: We permit third party advertising networks and providers to collect information regarding the use of our Services to help us to deliver targeted online advertisements to you. Such third parties use cookies and similar technologies to gather information about your browser’s or device’s visits and usage patterns on our Services and on other websites over time, which helps to better personalize advertisements to match your interests and measure the effectiveness of ad campaigns.
  • As required by law: Under certain circumstances your Personal Information may be subject to processing pursuant to laws, regulations, judicial or other government subpoenas, warrants, or orders. For example, we may be required to disclose Personal Information in coordination with regulatory authorities in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. SoyKitty will preserve and disclose any and all information to law enforcement agencies or others if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (i) comply with legal or regulatory processes (such as a judicial proceeding, court order, or government inquiry) or obligations that SoyKitty may owe pursuant to ethical and other professional rules, laws, and regulations; (ii) enforce our Terms of Service and other SoyKitty policies; (iii) respond to claims that any content violates the rights of third parties; or (iv) protect the rights, property, or personal safety of SoyKitty, its employees, its users, its customers, and the public.
  • Business transactions: In the event that SoyKitty goes through a business transaction, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information may be among the assets transferred.

Your Acceptance of this Privacy Policy

By registering and/or using this Site, including, without limitation, signing up for offers and/or continuing to receive information from Company, you signify your acceptance of this Policy, and you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is subject to the Terms and Conditions of Use of Use posted on the Site. If you do not agree to the terms of this Policy, in whole or part, you should not use this Site, and should instantly cancel your registration (if you have signed up) by following the directions in the section “Opting-Out of Further Communications and Cancelling Your Account”.

Registration; Collection and Use of Information

Anyone completing and submitting any or part of the forms on the Site is considered a “registrant.”

Collection of PII

Company only gathers PII that is volunteered during the registration process or in response to specific information requests. Examples of PII that may be requested consist of name, address, email address, and telephone number. We also collect credit card or other payment account information in connection with any purchase you make on or through the Site. The decision to provide PII is optional on your part; however, if you decide not to register or provide such information, you may not be able to make purchases on or use certain features of the Site or other services on or through the Site.

Depending on how you interact with our Site, the personal information we collect from you may vary. If you connect to the Site using Facebook, Google+, or another social networking site (each a “Social Networking Site”), we will receive information that you authorize the Social Networking Site to share with us, which may include public profile information, birthday, current city work, school, and email address. When we receive this information, it becomes Company’s account information for purposes of your use of the Site. This information also constitutes personal information and is therefore subject to this Policy. Any information that we collect from your Social Networking Site account may depend on the privacy settings you have set with the Social Networking Site, so please consult the Social Networking Site’s privacy and data practices. You have the ability to disconnect your Social Networking Site account from your account with us by adapting the privacy settings in your Social Networking Site account. If you come to the Site through a Social Networking Site, from other websites or with devices that enable third parties to collect information from or about you, such third parties receive information about you subject to their privacy policies.

Use of Information

We use your PII and non-personal information for internal purposes, such as to provide you with the Site and services, to notify you of new products or services, and to otherwise communicate with you.

To the extent third parties may place advertising on the Site, such third parties may utilize cookies or other tracking technologies. We are not responsible for information collected by third parties in this manner, nor for the collection or use of information by other sites to which the Site is linked.

By providing PII and other information to this Site, registrant fully understands and expressly consents to the collection and use of such information and the transfer of such information to Network Sites and other parties, in accordance with the terms of this Policy.

Sharing Information

Company reserves the right to use registrant PII: (1) as disclosed at the time such information is provided and (2) as disclosed in this Policy.

We DO NOT rent, sell, or otherwise share your PII and non-personal information with anyone, for any purpose, other than for those limited purposes described herein below.

By clicking “Submit” and providing personal information on or through the Site, you agree:

  • all information you have provided is true and correct to the best of your knowledge;
  • you are establishing a business relationship with Company and its other marketing partners; and
  • you are requesting and expressly consenting to be contacted via telephone (whether wireless or wired, including calls and SMS texts using an automated telephone dialing system), email, and/or mail by us with offers of other products and services, and for any other legitimate purpose, regardless of whether your telephone number is on any Do Not Call list(s)

To process payments of purchases you make on the Site, we may share some of your personal information, including credit card or other account information, with third party service providers who help us process transactions on the site. These service providers are under contract to only use your information in connection with the services they perform for us.

We may work with third-party marketing and advertising companies (“Ad Networks”). We do not sell PII to these companies. However, on their own they may collect and use information about your use of the Site or services in order to provide advertisements about goods and services that may be of interest to you. Advertisements may be shown via the Site, the services, or third-party sites. These companies may place or recognize a unique cookie on your computer or use other technologies such as Web beacons. Data such as IP address, cookie identifiers or other tracking technologies such as pixels, and end-user website activity may be collected for targeted advertising purposes. Our Privacy Policy does not cover any use of information that an Ad Network may collect from you. It also does not cover any information that you may choose to provide to an Ad Network or to an advertiser whose goods or services are advertised through the Site.

If you do not concur that Company may share your PII and non-personal information as described in this Privacy Policy, you should not register on and use the Site and, do not click on the subscribe checkbox at checkout and, if you are already registered, you must immediately cancel your account, by following the instructions in “Opting-Out of Further Communications and Cancelling Your Account”.

Company attempts to advise others who receive registrant PII to support this Privacy Policy. Please be aware, however, that we have no control over such other party’s information use practices and we are not liable for any failure of such party to adhere to this Policy or otherwise to violate your privacy.

Finally, Company may disclose registrant PII in order to: (1) comply with applicable laws; (2) respond to governmental inquiries; (3) comply with valid legal process; and (4) protect the rights or property of Company, the Network Sites, or other registrants of this Site.

California Privacy Law

On January 1, 2020, the California Consumer Privacy Act of 2018 (“CCPA”) went into effect. The CCPA offers significant new data privacy protections to California residents. Because it cares about your privacy, SoyKitty, LLC has chosen to conform its data privacy policy and practices to the requirements of the CCPA for your benefit, whether or not you reside in California.

In addition to the disclosure of our collection, use and protection of your personal information, and the choices and rights you have with respect to that personal information, set forth elsewhere in this privacy policy, you are entitled to these further disclosures and rights under the CCPA:

Right to Request Information about Your Personal Information

Free of charge, you have the right to request for the last 12 months, and receive within 45 days (and in any event no more than 90 days:

(1) The categories of personal information we have collected about you;

(2) The categories of sources from which the personal information is collected;

(3) The business or commercial purpose for collecting or selling your personal information;

(4) The categories of third parties with whom we share your personal information; and

(5) The specific pieces of personal information we have collected about you.

We must provide this information to you in a readily usable format that allows you to easily send the information to and between other entities, thus allowing you to “port” or move your personal information from us to another company offering similar services.

Under the CCPA, “Personal Information” includes, but is not limited to, identifiers such as a real name, alias, postal address, unique personal identifier (including cookies), online identifier Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

Right to Request Deletion of Your Personal Data

Free of charge, you have the right to request the deletion of your personal information that we have collected from you. We shall comply with that request by deleting all of your personal information from our records and directing any service providers to delete your personal information from their records.

Some exceptions do exist to our duty to delete your personal information at your request. These are when your personal information may be needed to:

(1) Complete a transaction for which your personal information was collected, provide a good or service that you requested, or that we could reasonably anticipate within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you;

(2) Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;

(3) Debug to identify and repair errors that impair existing intended functionality;

(4) Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

(5) Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code;

(6) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that follows applicable ethics and privacy laws, when our deletion of your information is likely to prevent or seriously impair the achievement of such research, if you have provided informed consent’;

(7) To enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

(8) Comply with a legal obligation;

(9) Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Right to Receive Equal Service and Pricing, Even if Exercising Your Privacy Rights

Pursuant to the CCPA, we cannot and will not discriminate against or penalize you for exercising your privacy rights. We will not:

(1) Charge different prices for our service;

(2) Provide a different level or quality of service to you;

(3) Suggest that you receive a different price for, or a different level or quality of, our service;

Provided, however, the CCPA does not prohibit differences in prices, levels or quality of service offered to users if the difference is reasonably related to the value provided to the consumer by the consumer’s data.

How to Make Requests Regarding Your Personal Information

Mobile Messaging Service Terms and Conditions

SoyKitty, LLC operates a mobile messaging service (the “Service”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to SoyKitty, LLC’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of SoyKitty, LLC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with SoyKitty, LLC. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Simply text back the keyword command STOP to (888) 904-4210 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other SoyKitty, LLC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Opting-Out of Further Communications and Cancelling Your Account

Site registrants may opt-out of receiving further communications from the Company. Registrants may, at any time, choose not to receive promotional emails from Company by (1) following the “unsubscribe” instructions in any such e-mail received by the registrant, or (2) writing at: meow@soykitty.com.

Note that unsubscribing from one email list does not automatically unsubscribe you from any other email list that you may be on. Please read the email carefully to find out which list you are unsubscribing from.

Registrants also may opt out of receiving telephone calls from Company with whom we have shared your information by requesting to be placed on its company-specific do-not-call list.

Registrants and users may cancel their account by writing to meow@soykitty.com.

Transfer In Certain Circumstances

In its sole discretion, Company may transfer, sell or assign information collected on and through this Site, including without limitation, PII and other registrant-provided information, to one or more third parties, as a result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of Company and/or Network Sites.

Security, Fraud, and Abuse

This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. Company regularly reviews these measures to better protect you. However, we do not and cannot guarantee the security or integrity of the information, and we have no liability for breaches of said security or integrity or third-party interception in transit. Please be advised that any transmission of data at or through the Site is at your own risk.

Must Be 18 Years or Older

Neither Company nor the Network Sites are intended for, or directed to, children under the age of 18. If we learn that a person who registers on the Site is under the age of 18, we will promptly delete that individual’s registration.

Links to Other Sites

The Site may contain links to other sites, or allow others to send you such links. A link to a third party’s site does not mean we endorse it or are affiliated with it. We exercise no control over third-party sites and are not responsible for the privacy practices or content of those sites. Your access to such third-party sites or content is at your own risk. You should always read the privacy policy of a third-party site before providing any information to the site.

Change in Policy

Company may, from time to time, amend this Policy, in whole or part, in its sole discretion. Depending on the nature of the change, we will either announce the change (1) on the privacy policy page of the site, or (2) provide such notice via e-mail to registrants. Those changes will go into effect on the revision date shown in the revised Privacy Policy. Your continued use of our Site and services constitutes your consent to be bound by the revised Privacy Policy. If you do not agree with the terms of this Policy, as it may be amended from time to time, in whole or part, you must terminate your registration by unsubscribing at: meow@soykitty.com and cease all further use of the Site.
